MODIFICATION OF OPINION ON DENIAL OF REHEARING

Gomes, J.

THE COURT:

It is ordered that the opinion herein filed on June 17, 2011, be modified as follows:

In the first full paragraph on page 4, strike the sentence that reads “That made no sense to Curtis, since nobody he knew there was a gang member.” and insert the following sentence in its place: “That made no sense to Curtis, since nobody he knew there was an ‘East Side’ gang member.”

This modification does not effect a change in the judgment.

Appellant’s petition for rehearing and motion for judicial notice are denied.
