An order of this Court having been entered on April 23, 2019 (M-786) granting defendant leave to prosecute, as a poor person, the appeal taken from a judgment of the Supreme Court, New York County, rendered on or about November 29, 2018, and assigning Samuel M Braverman, Esq., as counsel to prosecute said appeal; and assigned counsel having moved to be relieved as such counsel, to substitute other counsel, to allow defendant to a file a supplemental or replacement brief, and for related relief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of striking the designation of Samuel M. Braverman, Esq., as assigned counsel to prosecute defendant's appeal, and substituting, pursuant to Section 722 of the County Law, Richard L. Herzfeld, Esq., 112 Madison Avenue, 8th Floor, New York, New York 10016, Telephone number 212-818-9019, as such counsel. Appellant's brief is deemed withdrawn and the time in which to perfect the appeal is extended to the September 2021 Term of this Court. ENTERED: March 30, 2021
