An order of this Court having been entered on May 08, 2018 (M-1508) granting defendant leave to prosecute, as a poor person, the appeal from the judgment of the Supreme Court, Bronx County, rendered on or about November 03, 2017, and assigning Seymour W. James, Jr., predecessor to Janet E. Sabel, Esq., The Legal Aid Society as counsel to prosecute the appeal; and a motion having been made to relieve such counsel, and for other relief,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent of striking the designation of Seymour W. James, Jr., predecessor counsel to Janet E. Sabel, Esq., The Legal Aid Society, as assigned counsel to prosecute defendant's appeal. That branch of the motion seeking to substitute Jonathan Edelstein, Esq. as retained counsel, is denied as unnecessary. The Probation Department is directed to provide defendant-appellant's counsel with a copy of the presentence report under New York Co. Ind. No. 70/15. ENTERED: November 10, 2020
