MODIFICATION OF OPINION AND DENIAL OF PETITION FOR REHEARING [No Change in Judgment]

BY THE COURT:

Appellant’s petition for rehearing in the above entitled matter is denied.

The nonpublished opinion filed in the above entitled action on June 25, 2007, is modified as follows. The last sentence of footnote one is stricken and replaced with the following:

The eight-page report included a blank piece of paper, a lab sheet, information from an internal affairs investigation initiated after appellant filed a complaint with the police department concerning McWilliams, and information concerning photographs. Although copies of the photographs were not included in the eight-page report, they were provided to the defense.

The modification does not affect the judgment.
