Opinion

2012-12-19

The PEOPLE, etc., respondent, v. Abdur JACOBS, appellant.

Steven A. Feldman, Uniondale, N.Y., for appellant. Kathleen M. Rice, District Attorney, Mineola, N.Y. (Jason R. Richards and Kevin C. King of counsel), for respondent.

Steven A. Feldman, Uniondale, N.Y., for appellant. Kathleen M. Rice, District Attorney, Mineola, N.Y. (Jason R. Richards and Kevin C. King of counsel), for respondent.

Appeal by the defendant from a judgment of the County Court, Nassau County (Carter, J.), rendered January 20, 2011, convicting him of criminal possession of a weapon in the second degree, upon his plea of guilty, and imposing sentence.

ORDERED that the judgment is affirmed.

The defendant's valid waiver of his right to appeal precludes review of his contention that the sentence imposed was excessive, as well as his contention that he received the ineffective assistance of counsel regarding that sentence ( see People v. Lopez, 6 N.Y.3d 248, 255, 811 N.Y.S.2d 623, 844 N.E.2d 1145;People v. Collier, 71 A.D.3d 909, 910, 895 N.Y.S.2d 848).

ANGIOLILLO, J.P., BALKIN, AUSTIN and MILLER, JJ., concur.
