PEOPLE of the State of Michigan, Plaintiff-Appellee, v. Jessica Lynn HURLEY, Defendant-Appellant.


Order

On order of the Court, the application for leave to appeal the May 19, 2022 judgment of the Court of Appeals is considered. We direct the Clerk to schedule oral argument on the application. MCR 7.305(H)(1). The parties shall file supplemental briefs in accordance with MCR 7.312(E) addressing: (1) whether a verdict may be impeached based on juror misconduct if the misconduct occurred prior to the jury's deliberative process, see People v Budzyn , 456 Mich. 77, 566 N.W.2d 229 (1997) ; and (2) whether there may be cases of "juror bias so extreme that, almost by definition, the jury trial right has been abridged," see Warger v Shauers , 574 U.S. 40, 135 S.Ct. 521, 190 L.Ed.2d 422 (2014), and if so, whether that exception applies to the facts of this case?

The Prosecuting Attorneys Association of Michigan and the Criminal Defense Attorneys of Michigan are invited to file briefs amicus curiae. Other persons or groups interested in the determination of the issues presented in this case may move the Court for permission to file briefs amicus curiae.
