IT IS ORDERED that the opinion filed in the above-captioned matter on August 25, 2011, be modified as follows:
On page 2, the first paragraph, first sentence starting with "Following a jury trial. . ." should be deleted and replaced with "Following a jury trial, Michael Robert Hubbard was convicted of second degree murder."
This modification effects no change in the judgment.
