People v. Hodges

Appellate Division of the Supreme Court of New York, Second Department
Nov 30, 1992
187 A.D.2d 730 (N.Y. App. Div. 1992)

Opinion

November 30, 1992

Appeal from the Supreme Court, Westchester County (Scarpino, J.).

Ordered that the judgment is affirmed.

We have examined the record and find that the defendant's plea of guilty was knowingly and voluntarily entered and that the sentence imposed was not illegal.

Appellate review of the remaining issue raised by the defendant was effectively waived by him as part of his plea bargain. Accordingly, the judgment of conviction is affirmed (see, People v Callahan, 80 N.Y.2d 273; People v Seaberg, 74 N.Y.2d 1). Bracken, J.P., Lawrence, Miller, Copertino and Santucci, JJ., concur.
