Defendant having moved pursuant to CPL 460.30 to extend the time to move for leave to appeal from an order of the Oswego County Court, dated September 28, 2012,

Now, upon reading and filing the affidavit of Michael Hirsh sworn to December 3, 2012, the notice of motion with proof of service thereof, the affirmation of Courtney Pettit, Esq. dated January 9, 2013, the affidavit of Michael Hirsh sworn to January 28, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and the Clerk is directed to accept the CPL 460.15 motion and copy of said motion submitted on January 9, 2013 for filing.
