People v. Hill

Appellate Division of the Supreme Court of New York, Second Department
May 30, 1989
150 A.D.2d 798 (N.Y. App. Div. 1989)

Opinion

May 30, 1989

Appeal from the Supreme Court, Kings County (Lagana, J.).

Ordered that the judgment is affirmed.

Viewing the evidence adduced at trial in the light most favorable to the prosecution (see, People v Contes, 60 N.Y.2d 620), we find that it was legally sufficient to establish the defendant's guilt. Moreover, upon the exercise of our factual review power (see, CPL 470.15), we conclude that the verdict of guilt was not against the weight of the evidence.

We have reviewed the defendant's remaining contention and find it to be without merit. Bracken, J.P., Sullivan, Balletta and Rosenblatt, JJ., concur.
