ORDER MODIFYING OPINION AND DENYING REHEARING [NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on May 24, 2007, be modified as follows:

On page 4, in the third sentence of the second full paragraph, insert the word “between” after the word “as” and the words “and six feet five inches” after the word “feet,” so that the beginning of that sentence reads: “He described the man he spoke to as between six feet and six feet five inches tall . . . .”

This modification does not change the judgment.

Defendant’s petition for rehearing is denied.
