On the court's own motion, order of May 25, 1961, directing reargument of the within appeal upon the question of the applicability of the decision in People v. Rosario ( 9 N.Y.2d 286), vacated. Counsel are directed to file briefs on the applicability of the Rosario case, appellants on or before June 28, 1961 and respondent on or before July 6, 1961.
