DECISION & ORDER ON MOTION

Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the Justice Court of the Town of East Hampton, Suffolk County, rendered July 31, 2014, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renewal upon appellant furnishing this court with proper papers.

Appellant has failed to furnish this court with the financial affidavit necessary to determine whether he is indigent, and has failed to explain how he paid for private counsel to represent him in the Justice Court.
