APPEAL from a judgment of the Superior Court of Placer County, No 62071378 Colleen M. Nichols, John L. Cosgrove, and Charles D. Wachob, Judges.

THE COURT:

It is ordered that the opinion filed herein on October 14, 2009, be modified as follows:

1. On page 1, the first paragraph should be changed to read as follows:

2. On page 6, the last sentence should be changed to read as follows:

“At the conclusion of the Marsden hearing (heard by Judge Colleen M. Nichols), the court ordered a substitution of counsel.”

3. On page 7, the first sentence should be changed to read as follows:

“In July 2008, defendant again made a Marsden motion (heard by Judge John L. Cosgrove).”

This modification does not change the judgment.
