862 N.W.2d 210 (Mich. 2015)

Opinion

Docket No. 150843. COA No. 316959.

04-28-2015

PEOPLE of the State of Michigan, Plaintiff–Appellant/Cross–Appellee, v. Paul Richard HEMINGER, Defendant–Appellee/Cross–Appellant.

Order

On order of the Court, the application for leave to appeal the November 20, 2014 judgment of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court. The application for leave to appeal as cross-appellant is considered and, it appearing to this Court that the cases of People v. Hartwick (Docket No. 148444) and People v. Tuttle (Docket No. 148971) are pending on appeal before this Court and that the decisions in those cases may resolve an issue raised in the present application for leave to appeal as cross-appellant, we ORDER that the application be held in ABEYANCE pending the decisions in those cases.

We further ORDER that any proceedings on remand as directed by the Court of Appeals are stayed pending the completion of this appeal.
