Opinion

2003-1126 WCR.

Decided July 1, 2004.

Appeal by defendant from a judgment of the City Court, City of New Rochelle, Westchester County (J. Colangelo, J.), rendered on March 17, 2003, convicting him, upon his guilty plea, of petit larceny (Penal Law § 155.25) and imposing sentence.

Judgment of conviction unanimously affirmed.

PRESENT: McCABE, P.J., RUDOLPH and ANGIOLILLO, JJ.

We have reviewed the record and agree with defendant's counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Geraghty, 286 AD2d 777).
