On order of the Court, the motion to re-open appellant's application for leave to appeal under MCR 7.205(F) is treated as a delayed application for leave to appeal from the September 28, 1999, decision of the Court of Appeals. The delayed application for leave to appeal is considered, and it is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D).
