Summary Dispositions March 21, 2000:

On order of the Court, the application for leave to appeal from the April 29, 1999 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1).

In lieu of granting leave to appeal, we REMAND the case to the Court of Appeals for consideration as on leave granted. We DIRECT that court to consider whether the trial court erred in concluding that a period of probation for up to 5 years under MCL 771.2(1); MSA 28.1132(1) was unavailable in this case.
