Extension of time granted

The record on appeal was filed on November 6, 2019. On April 4, 2024, the court granted appellant's thirty-fifth application for an extension of time until May 31, 2024, to file the opening brief, and stated, "[a]fter that date, no further extension will be granted." The opening brief was not filed on May 31, 2024. On June 3, 2024, appellant filed an "Application for Relief from Default," and a "Thirty-Sixth Motion for Extension of Time to File Appellant's Opening Brief." Neither document notes or addresses the circumstance that the court's April 4, 2024, order stated that "no further extension will be granted."

Appellant's "Application for Relief from Default," filed on June3, 2024, is granted. One final extension of time in which to serve and file appellant's opening brief is also granted to July 30, 2024. After that date, no further extension will be granted. Counsel for appellant is ordered to inform his assisting attorney or entity of this schedule, and to take all steps necessary to meet it. An application to file an overlength brief must be served and filed no later than 60 days before the anticipated filing date. (See Cal. Rules of Court, rule 8.631(d)(1)(B)(ii).)
