People v. Hart

Appellate Division of the Supreme Court of New York, Second Department
Sep 12, 1994
207 A.D.2d 805 (N.Y. App. Div. 1994)

Opinion

September 12, 1994

Appeal from the Supreme Court, Kings County (Demarest, J.).

Ordered that the sentence is affirmed.

Appellate review of the issue raised by the defendant was effectively waived by him as part of his plea agreement (see, People v. Callahan, 80 N.Y.2d 273; People v. Seaberg, 74 N.Y.2d 1).

We have, however, examined the defendant's contention that the sentence was excessive and find it to be without merit (see, People v. Kazepis, 101 A.D.2d 816). Mangano, P.J., Rosenblatt, Miller, Copertino and Krausman, JJ., concur.
