On order of the Court, the application for leave to appeal the May 15, 2015 order of the Court of Appeals is considered. We DIRECT the Kent County Prosecuting Attorney to answer the application for leave to appeal within 28 days after the date of this order. In particular, the prosecuting attorney shall address whether the defendant is entitled to a remand to the circuit court for further proceedings consistent with the terms of his guilty plea, and with this Court's decision in People v Hartwick, 498 Mich 192 (2015). We further INVITE the defendant to file a supplemental brief within 28 days of the date of this order addressing the impact of Hartwick on his application for leave to appeal.
The application for leave to appeal remains pending.
