PEOPLE of the State of Michigan, Plaintiff-Appellee, v. Daniel GUZMAN, Defendant-Appellant.


Order

By order of June 27, 2017, the prosecuting attorney was directed to answer Issue VI of the application for leave to appeal the October 14, 2016 order of the Court of Appeals. On August 15, 2017, the parties filed with the Clerk a stipulation to dismiss Issue VI, only, of the defendant's application and to permit resentencing consistent with the circuit court's ruling on the record. On order of the Court, the stipulation having been received, the application is again considered. Pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we REMAND this case to the Hillsdale Circuit Court for further proceedings consistent with the stipulation of the parties. In all other respects, leave to appeal is DENIED, because we are not persuaded that the remaining questions presented should be reviewed by this Court.

We do not retain jurisdiction.
