PEOPLE of the State of Michigan, Plaintiff–Appellee, v. Daniel GUZMAN, Defendant–Appellant.


Order

On order of the Court, the application for leave to appeal the October 14, 2016 order of the Court of Appeals is considered. We DIRECT the Hillsdale County Prosecuting Attorney to answer Issue VI of the application for leave to appeal within 28 days after the date of this order. In particular, the prosecuting attorney shall address whether the practice of sentencing by videoconference amounts to plain error, and whether the defendant is entitled to resentencing because of its use in this case. See MCR 6.006 ; People v. Heller , 316 Mich. App. 314 (2016).

The application for leave to appeal remains pending.
