An order of this Court having been entered on May 07, 2020 (M-872) granting defendant leave to prosecute, as a poor person, the appeal taken from a judgment of the Supreme Court, New York County, rendered on or about January 23, 2020, and assigning Robert S. Dean, Esq., Center for Appellate Litigation, as counsel to prosecute the appeal,

And defendant-appellant having moved, pro se, for an order relieving assigned counsel and for permission to proceed pro se on the appeal,

And by letter dated November 5, 2020, this Court having advised defendant of the consequences of proceeding pro se; and defendant having responded, by letter dated November 25, 2020, indicating his desire to proceed pro se,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, it is

Ordered that the motion is granted, and assigned counsel is relieved from any further obligation to represent defendant upon this appeal, and it is further

Ordered that defendant's poor person status is continued and he is authorized to proceed pro se, and it is further

Ordered that the Clerk is directed to forward to the Warden of the State correctional facility wherein defendant is incarcerated a transcript of the minutes relating to defendant's appeal, the transcript to be made available to defendant, without charge, and returned by him to this Court when submitting his pro se appellate brief, and it is further

Ordered that the time in which defendant shall perfect this appeal is extended until 120 days from the date of the filing of the record or the date of this order, whichever is later. Defendant is advised that the appeal will not be heard unless and until all material furnished to him has been returned to this Court. ENTERED: February 11, 2021
