Appeal from the County Court, Westchester County (Lange, J.).


Ordered that the judgment is modified, as a matter of discretion in the interest of justice, by deleting therefrom the condition of probation requiring the defendant to obtain the permission of his probation officer before visiting his brother in Connecticut, as so modified, the judgment is affirmed.

We agree with the County Court, Westchester County, that requiring the defendant to obtain the permission of his probation officer before visiting his brother in Connecticut is not a necessary condition of probation.

O'Brien, J.P., Altman, Friedmann and Krausman, JJ., concur.
