Opinion

11-17-2003

THE PEOPLE, Plaintiff and Respondent, v. BARTOLO ORTEGA GONZALEZ, Defendant and Appellant.

Marilyn Drath, under appointment by the Court of Appeal, for Defendant and Appellant. Bill Lockyer, Attorney General, Robert R. Anderson, Chief Assistant Attorney General, Jo Graves, Assistant Attorney General, and Carlos A. Martinez, Deputy Attorney General, for Plaintiff and Respondent.

OPINION

Appellant Bartolo Gonzalez pled no contest to possession of methamphetamine for purposes of sale (Health & Saf. Code, § 11378) and admitted enhancement allegations that the amount of methamphetamine possessed exceeded one kilogram by weight (Health & Saf. Code, § 11370.4, subd. (b)(1)) and that he had suffered a prior conviction of violating Health and Safety Code section 11352 (Health & Saf. Code, § 11370.2, subd. (c)). The court imposed a prison term of eight years, consisting of the two-year midterm on the substantive offense and three years on each of the enhancements.

Appellants appointed appellate counsel has filed an opening brief which summarizes the pertinent facts, with citations to the record, raises no issues, and asks that this court independently review the record. (People v. Wende (1979) 25 Cal.3d 436.) Appellant has not responded to this courts invitation to submit additional briefing.

Following independent review of the record, we have concluded that no reasonably arguable legal or factual issues exist.

The judgment is affirmed.
