By order of December 21, 1999, the Kent County Prosecuting Attorney was directed to show cause. On order of the Court, the prosecuting attorney's response having been filed, the application for leave to appeal from the March 2, 1999 decision of the Court of Appeals is again considered, and it is DENIED because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., would grant leave to appeal.
