ORDER

Kathleen Jansen, Presiding Judge.

Pursuant to MCR 7.205(E)(2), in lieu of granting the application for leave to appeal, that portion of the October 16, 2023 judgment of sentence imposing a $250.00 fine on defendant's conviction under MCL 750.520d is VACATED. In all other respects, the application is DENIED for lack of merit in the grounds presented.

This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction. Presiding Judge

Garrett, J., agrees to vacate the fine but would grant the application for leave to appeal to consider whether defendant's attempted suicide constituted interference with the administration of justice for purposes of scoring offense variable 19.
