No. B222960 (Cal. Ct. App. Dec. 14, 2010)

Opinion

NOT TO BE PUBLISHED

APPEAL from a judgment of the Superior Court of Los Angeles County No. BA338118 Carol W. Elswick, Judge.

Kelly Cronin Martin, under appointment by the Court of Appeal, for Defendant and Appellant.

No appearance for Plaintiff and Respondent.

MALLANO, P. J.

In April of 2008, defendant Richard Garcia pleaded guilty to possession of a controlled substance and possession of drug paraphernalia. The trial court suspended imposition of sentence and placed defendant on probation. On November 23, 2009, defendant opened the door of his motel room to a Baldwin Park Police officer. The officer saw a methamphetamine pipe on a table four feet from the door. Defendant admitted the pipe was his. The officer searched defendant and found a small plastic bag containing methamphetamine on defendant’s person. Following a probation violation hearing, the trial court revoked defendant’s parole and sentenced him to two years in prison.

After examination of the record, counsel filed an opening brief raising no issues and asking this court to independently review the record. On November 4, 2010, we advised defendant he had 30 days within which to personally submit any contentions or issues he wished us to consider. To date, we have received no response.

We have examined the entire record and are satisfied that defendant’s attorney has fully complied with her responsibilities and that no arguable issues exist. (People v. Kelly (2006) 40 Cal.4th 106, 109–110; People v. Wende (1979) 25 Cal.3d 436, 441.)

DISPOSITION

The judgment is affirmed.

We concur: CHANEY, J., JOHNSON, J.
