On order of the Court, the delayed application for leave to appeal from the June 6, 2001 decision of the Court of Appeals is considered, and it is DENIED because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh, and Taylor, JJ., would remand to the Court of Appeals for consideration as on leave granted.

Kelly, J., would direct the prosecutor to respond to defendant's application.
