THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. JAVELL FOX, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved for an extension of time to perfect the appeal taken from the order of Supreme Court, Oneida County, dated September 20, 2013,

Now, upon reading and filing the affidavit of Javell Fox sworn to June 30, 2015, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the pro se notice of appeal dated June 30, 2015, which was served upon the Oneida County District Attorney's Office on June 30, 2015 and filed in the Oneida County Clerk's Office on July 8, 2015, is hereby deemed timely served and filed, and

It is further ORDERED that the motion is granted on the condition that appellant perfect the appeal on or before October 26, 2015, and in the event of failure to so perfect, the appeal is hereby dismissed without further order.
