Opinion

THE PEOPLE, Plaintiff and Respondent, v. PATRICK FOOTE, Defendant and Appellant.

Bernard R. Ussery, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

A jury convicted appellant Patrick Foote of taking a vehicle without the owners consent and possession of a controlled substance (Veh. Code, § 10851, subd. (a); Health & Saf. Code, § 11350, subd. (a)). He was sentenced to concurrent state prison terms of one year four months.

We appointed counsel to represent him on appeal.

After examination of the record, counsel filed an "Opening Brief" in which no issues were raised. On May 15, 2005 we advised Foote that he had 30 days within which to personally submit any contentions or issues that he wished us to consider. No response has been received to date.

On June 3, 2003 we denied Footes pro se request of May 29, 2003 for new counsel.

We have examined the entire record and are satisfied that Footes attorney has fully complied with the responsibilities of counsel and that no arguable issues exist. (Smith v. Robbins (2000) 528 U.S. 259, 277-284, 145 L. Ed. 2d 756, 120 S. Ct. 746; People v. Wende (1979) 25 Cal.3d 436, 441, 158 Cal. Rptr. 839, 600 P.2d 1071.)

The judgment is affirmed.

We concur: JOHNSON, J., MUNOZ (AURELIO), J. --------------- Notes: Judge of the Los Angeles Superior Court assigned by the Chief Justice pursuant to article VI, section 6 of the California Constitution.
