People v. Dozier

Appellate Division of the Supreme Court of New York, Second Department
Jun 10, 1996
228 A.D.2d 516 (N.Y. App. Div. 1996)

Opinion

June 10, 1996

Appeal from the County Court, Suffolk County (Cacciabaudo, J.).

Ordered that the purported appeal is dismissed, as no notice of appeal was filed from the judgment rendered upon Indictment No. 1473/94; and it is further,

Ordered that the judgment, as amended, rendered upon Indictment No. 306/95 is affirmed.

To the extent that the defendant contends that he received ineffective assistance of counsel at the plea proceeding under Indictment No. 306/95, his contention is without merit (see, People v. Baldi, 54 N.Y.2d 137). Moreover, the defendant's plea of guilty was knowingly, intelligently, and voluntarily entered (see, People v. Harris, 61 N.Y.2d 9; People v. Francabandera, 33 N.Y.2d 429).

The defendant's remaining contentions are without merit. O'Brien, J.P., Ritter, Pizzuto and Altman, JJ., concur.
