People v. Deveaux

Appellate Division of the Supreme Court of New York, Third Department
Nov 30, 1970
35 A.D.2d 887 (N.Y. App. Div. 1970)

Opinion

November 30, 1970

Appeal from a judgment of the County Court, Chemung County, entered on a plea of guilty of the crime of rape in the first degree (Penal Law, § 130.35). We find no basis to disturb appellant's plea of guilty, nor do we find that the trial court's sentence on the instant record is excessive and, accordingly, the judgment is affirmed. Judgment affirmed. Herlihy, P.J., Reynolds, Staley, Jr., Cooke and Sweeney, JJ., concur.
