Oct 8, 1951
279 App. Div. 596 (N.Y. App. Div. 1951)

Opinion

October 8, 1951.

Appeal from County Court of the County of Kings.

The grounds of the motions were that defendant's counsel was not present at the time of the pronouncement of judgment, and that the sentence of the court was more severe than had been promised by the prosecutor, despite the fact that the court had knowledge of the claimed promise. Orders affirmed. No opinion. Nolan, P.J., Johnston, Adel, Wenzel and MacCrate, JJ., concur.
