ORDER

Hon. Ellen Gesmer, Associate Justice

Defendant Arthur Dawson, having made an application, pursuant to CPL 245.70(6), for expedited review of a ruling of a Justice of the Supreme Court, New York County, as set forth in an order dated January 21, 2021, which granted the People's motion for a protective order, and, upon review, to vacate or modify the ruling, Now, upon reading and filing the papers with respect to the application; it is

Ordered that the application is granted to the extent of modifying the protective order to require the People to disclose to counsel for defendant Dawson, Michael Mandel, Esq., no later than May 23, 2022, the items listed in paragraph 7(b) of the People's affirmation dated January 20, 2021; and it is further

Ordered that, unless directed otherwise by court order, counsel for defendant Dawson, Michael Mandel, Esq., and employees of J&L Investigations, the private investigation firm counsel has retained to assist counsel in this matter, shall maintain exclusive possession of the materials listed in paragraph 7(b) of the protective order; shall not allow any other person to reproduce the materials in any manner at any time, including by photographing, copying, uploading to social media, or distributing those materials in any public forum; and shall not disclose those materials or the contents of those materials to defendant Dawson until immediately prior to jury selection in this matter; and it is further

Ordered that the application is otherwise denied, and it is further

Ordered that the papers submitted in connection with the application are deemed to be filed under seal and shall continue to be sealed.
