Application by the appellant for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this court dated December 30, 2002 ( People v. Davis, 300 A.D.2d 673), affirming a judgment of the Supreme Court, Kings County, rendered November 8, 2000.

Ramal Davis, a/k/a Kaleal Seifu, Coxsackie, N.Y., appellant pro se.

The appellant has failed to establish that he was denied the effective assistance of appellate counsel ( see Jones v. Barnes, 463 U.S. 745; People v. Stultz, N.Y.3d [May 4, 2004]).
