The People of the State of New York, Respondent, v. Jamal Delroy Dale, also known as Deroy Dale, Defendant-Appellant.


An order of this Court having been entered on December 5, 2017 (M-4596), inter alia, granting defendant leave to prosecute, as a poor person, the appeal taken to this Court from a judgment of the Supreme Court, New York County, rendered on or about May 30, 2017, and assigning Christina Swarns, Esq., predecessor counsel to Stephen Chu, Esq., Office of the Appellate Defender, as counsel to prosecute the appeal; and assigned counsel having moved to be relieved as counsel and to dismiss defendant-appellant's appeal without prejudice, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,It is ordered that the motion is granted to the extent of relieving assigned counsel and deeming the appeal withdrawn.
