Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Supreme Court, Erie County, rendered September 6, 2013,

Now, upon reading and filing the affidavit of Michael J. Stachowski, Esq. sworn to December 27, 2016, the notice of motion with proof of service thereof, the statement of Michael J. Flaherty, Jr., Esq. dated December 27, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the dismissal of the appeal is vacated on the condition that the appeal is perfected on or before April 20, 2017.
