On order of the Court, the motion to file an amended application for leave to appeal is GRANTED. The delayed application for leave to appeal the January 14, 1999 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., state as follows:

We would remand this case to the Court of Appeals for consideration of the defendant's application for leave to appeal. For purposes of the time limit in MCR 7.205(F)(3), the dispositive order was the September 22, 1997 order that denied the defendant's combined motion and memorandum to set aside denial of the motion for relief from judgment.
