DECISION & ORDER ON MOTION

(Original Decision & Order on Motion dated February 14, 2018)

Motion by respondent for leave to reargue an appeal from a judgment of the District Court of Nassau County, Nassau County Traffic and Parking Violations Agency, entered August 20, 2015, and an order of that court entered September 1, 2015, which was determined by decision and order of this court dated October 26, 2017, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion seeking leave to reargue is denied; and it is further,

ORDERED that the branch of the motion seeking leave to appeal to the Appellate Division is granted.
