MOTION DECISION

An order of this Court having been entered on July 22, 2021 (Motion No. 2021-01840) continuing the poor person relief previously granted to defendant with respect to the appeal taken to this Court from an order of the Supreme Court, New York County, entered on or about April 23, 2019 (Case No. 2019-5889), and assigning Robert S. Dean, Esq., as predecessor to Jenay Nurse Guilford, Esq., Center for Appellate Litigation, as counsel to prosecute the appeal; and

An order of this Court having been entered on September 16, 2021 (Motion No. 2021-02596) continuing the poor person relief previously granted to defendant with respect to the appeal taken to this Court from a judgment of the Supreme Court, New York County, rendered on or about September 29, 2016 (Case No. 2017-942), and assigning Robert S. Dean, Esq., as predecessor to Jenay Nurse Guilford, Esq., Center for Appellate Litigation, as counsel to prosecute the appeal; and

Defendant, pro se, having moved to relieve Center for Appellate Counsel as counsel assigned to prosecute his appeal under Case No. 2019-5889, and for an order substituting different counsel, and for related relief (Motion No. 2023-03790); and

Assigned counsel having moved to be relieved as counsel assigned to prosecute defendant's appeals under Case Nos. 2017-942 and 2019-5889 (Motion No. 2023-04571), and to have different counsel substituted, Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,

It is ordered that the motions are granted to the extent of striking the designation of Robert S. Dean, Esq., as predecessor to Jenay Nurse Guilford, Esq., Center for Appellate Litigation, as assigned counsel to prosecute defendant's appeals under Case Nos. 2017-942 and 2019-5889, and substituting, pursuant to Section 722 of the County Law, Twyla Carter, Esq., The Legal Aid Society, 199 Water Street, 5th Floor, New York, New York 10038, Telephone No. 212-577-3688, as such counsel. The poor person relief previously granted is continued, and appellant's time in which to perfect the appeal is extended until 120 days from the date of this order or the receipt of the complete record, whichever is later (Motions Nos. 2023-03790 and 2023-04571).
