People v. Cohen

Appellate Division of the Supreme Court of New York, Second Department
Nov 30, 1942
265 App. Div. 884 (N.Y. App. Div. 1942)

Opinion

November 30, 1942.

Appeal from Court of Special Sessions of the City of New York.

Judgments reversed on the law, informations dismissed, fine remitted and defendant discharged. The requirement that a price list be conspicuously posted, as set forth in section 169-f Gen. Bus. of the General Business Law, is imposed solely on the licensee. There was no proof adduced by the People that this defendant was a licensee, but to the contrary, it was undisputed that he was an employee of a licensee. Lazansky, P.J., Hagarty, Carswell, Adel and Taylor, JJ., concur.
