On order of the Court, the application for leave to appeal from the December 4, 1998 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the question presented should now be reviewed by this Court.

CAVANAGH and KELLY, JJ., would remand this case to the Court of Appeals with instructions that it remand the case to the Midland Circuit Court to allow defendant to file a motion for new trial and for an evidentiary hearing.
