MOTION DECISION

PRESENT: Hon. Anil C. Singh, Justice Presiding, Tanya R. Kennedy Saliann Scarpulla Martin Shulman, Justices.

An order of this Court having been entered on August 14, 2014 (M-1942) granting defendant leave to prosecute, as a poor person, the appeal taken from a judgment of the Supreme Court, New York County, rendered on or about April 02, 2013, and assigning Robert S. Dean, Esq., Center for Appellate Litigation, as counsel to prosecute the appeal, and said appeal having been perfected, And assigned counsel having moved for an order abating the appeal, and remanding the matter to Supreme Court to vacate the judgment of conviction, and to dismiss the indictment, by reason of defendant-appellant's death, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew, upon movant's submission of a copy of defendant's death certificate.
