Opinion

NOT TO BE PUBLISHED

Superior Court County No. F408359, of San Luis Obispo, Michael L. Duffy, Judge.

Richard B. Lennon, under appointment by the Court of Appeal, for Defendant and Appellant.

No appearance for Plaintiff and Respondent.

GILBERT, P.J.

Raymond Leroy Carper appeals a judgment of conviction entered after he expressly waived his constitutional rights and pleaded nolo contendere to the sale of cocaine, with an admission that he suffered a prior narcotics conviction. (Health & Saf. Code, § 11352, subd. (a), 11370.2, subd. (c).) The trial court sentenced Carper to a stipulated sentence of an upper term of five years, enhanced by three years for the prior narcotics conviction. The trial court also imposed a $1,600 restitution fine, and a $1,600 parole revocation restitution fine. It awarded Carper 187 days of presentence custody and conduct credits.

We appointed counsel to represent Carper in this appeal. After counsel's examination of the record, he filed an opening brief raising no issues.

On July 15, 2008, we advised Carper that he had 30 days within which to personally submit any contentions or issues that he wished to raise on appeal. We have not received a response from him.

We have reviewed the entire record and are satisfied that Carper's attorney has fully complied with his responsibilities and that no arguable issue exists. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The judgment is affirmed.

We concur: COFFEE, J., PERREN, J.
