On May 29, 2002, we vacated the judgment of the Court of Appeals and remanded this case to the district court for reconsideration, while retaining jurisdiction. People v Carlson, 466 Mich. 130 (2002). On order of the Court, the district court's decision on reconsideration having been issued, the application for leave to appeal is again considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we AFFIRM the decision of the district court after remand.
