Opinion

No. 2007-11512.

November 25, 2008.

Appeal by the defendant from a judgment of the County Court, Orange County (DeRosa, J.), rendered November 23, 2007, convicting him of criminal assault in the first degree, upon his plea of guilty, and imposing sentence.

Edward C. Bruno. Pine Bush, N.Y., for appellant.

Francis D. Phillips II, District Attorney, Goshen, N.Y. (Luke E. Bovill of counsel), for respondent.

ROBERT A. SPOLZINO, J.P., FRED T. SANTUCCI, HOWARD MILLER, THOMAS A. DICKERSON, RANDALL T. ENG, JJ.

Before: Spolzino, J.P., Santucci, Miller, Dicker son and Eng, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
