People of Michigan v. Samuel Joel Burch

LC No. 14-036180-FC

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The delayed application for leave to appeal from the May 10, 2022 order is DISMISSED for lack of jurisdiction because appellant failed to file the application within the time period required by MCR 7.205(A).

Insofar as defendant asserts that this Court may exercise jurisdiction on the basis of the Genesee County Circuit Court's oral ruling on April 20, 2023, the application for leave to appeal is DISMISSED for lack of jurisdiction because the lower court had not entered an order before appellant filed the application on October 20, 2023; thus, the application is premature. MCR 7.203(B) and 7.205(A).
