The People of the State of New York, Respondent, v. Marcos Buelvas, Defendant-Appellant.

Defendant appeals from a judgment of the Criminal Court of the City of New York, New York County (Felicia A. Mennin, J.), rendered August 24, 2013, convicting him, upon a plea of guilty, of unlawful possession of marihuana, and imposing sentence.

Per Curiam.

Judgment of conviction (Felicia A. Mennin, J.), rendered August 24, 2013, reversed, on the law, accusatory instrument dismissed, and fine and surcharge, if paid, remitted. (See People v Taylor, appeal numbered 12-215, decided herewith.)
